SMS Terms of Service

1. Program Description

LOMOKE offers a mobile messaging program (the "Program") to provide clients with appointment reminders, status updates on bespoke commissions, and occasional brand announcements. By opting into the Program, you agree to these Terms and Conditions.

2. User Opt-In

Users opt into the Program by providing their mobile number through our website forms or during an in-person consultation at our Union, NJ atelier.

3. Message Frequency

LOMOKE does not send "bulk" marketing. Message frequency varies and is transactional depending on your active project status. You can expect messages primarily around fitting schedules and garment readiness.

4. Cost and Data Rates

LOMOKE does not charge a fee for the Program; however, message and data rates may apply from your mobile carrier. Check your mobile plan for details. LOMOKE is not responsible for any messaging or data charges incurred.

5. How to Opt-Out (Stop)

If you do not wish to continue participating in the Program, you can opt-out at any time. Text STOP to our business number in response to any message. You will receive a one-time confirmation text that you have been unsubscribed, and no further messages will be sent unless you re-initiate the service.

7. Carrier Disclaimer

Mobile carriers (such as AT&T, T-Mobile, and Verizon) are not liable for delayed or undelivered messages.

Email & Digital Communication Terms

1. Electronic Communications

By contacting LOMOKE via email or opting into our "Atelier Updates," you agree to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications provided to you electronically satisfy any legal requirement that such communications be in writing.

2. Design Intellectual Property

All design sketches, "Technical Specification" sheets, and proprietary "Signature Fit" philosophies shared via email remain the exclusive intellectual property of LOMOKE LLC. Unauthorized reproduction, distribution, or use of these digital assets without express written consent is strictly prohibited.

3. Estimates and Quotes

Any pricing or project timelines provided via email are preliminary estimates based on initial consultations. Final pricing is subject to fabric market fluctuations and specific design refinements. A quote is only finalized once a formal Service Agreement is signed and a 50% deposit is received.

4. Confidentiality

Information contained in LOMOKE emails may be privileged and confidential. If you are not the intended recipient, you are notified that any dissemination, distribution, or copying of our digital communication is strictly prohibited.

5. Limitation of Liability

LOMOKE utilizes secure, encrypted servers (Microsoft 365); however, we are not liable for any harm resulting from the interception of emails by third parties or for technical issues arising from the transmission of digital files.
